Barber case headed to Supreme Court

KIRKSVILLE, MO. -- The appeal of his conviction by a former Kirksville dentist continues to move slowly through the court system.

Steve Barber, 74, of Kirksville, was convicted  in June 2011 on two felony counts of tampering with a witness. Later that month, he was sentenced to five years in prison on each count.

Barber then appealed his conviction to the Western District Court of Appeals, which ordered the case be sent back to the circuit court for re-trail. The ruling was appealed by the state attorney general's office, who asked the appeals court to reconsider its ruling or send the case to the Missouri Supreme Court.

The appeals court has now sent the case to the state Supreme Court for a ruling. Members of the Supreme Court have not yet decided if they will accept the case for a ruling.

Meanwhile, Barber remains free on a $5,000 bond pending the outcome of his appeal.
