How many DWIs are too many?

KIRKSVILLE, MO. -- How many DWIs can someone get before they lose their license? That was the topic for Thursday’s “Facebook Story of the Day”.

In the state of Missouri, you can lose your license after your first offense.

First Offense: Lose license for 90 days. During the first 30 days you are not allowed to drive. The other 60 days fall under limited driving privileges.

“If you are placed under limited driving privileges you can drive to and from work, treatment, school or medical care,” said Adair County Prosecutor Matt Wilson.

Second Offense: Lose license for one year by the point system, but you actually fall into what the state calls a 5-year-denial.

“You can actually lose your license for five years. The first two years of that is hard walk, what that means is you can’t drive at all during that time period,” said Wilson. “After those two years you can petition for limited driving privileges.”

Third Offense: Lose license for 10 years which the state calls a 10-year-denial. You can get limited driving privileges after three years.

In the state of Missouri, a third DWI is considered a felony, and you can lose all driving privileges for 10 years. Fourth Offense: Lose license for good.

Hefty fines also come with a DWI conviction.

“First offense is considered a B misdemeanor and that carries a fine up to $500. Second offense within five years is considered an A misdemeanor and carries a fine up to $1,000,” said Wilson. “If a person gets a third or fourth DWI conviction those are considered C and D felonies and carry a fine of up to $5,000. On your fifth offense there are no fines, its mandatory prison time.”

Not only do you lose your license or face hefty fines when you are convicted of a DWI, but you can also face jail time.

First offense: Under the state statute, if you have a blood content level of .15, you have to do at least two days in jail plus probation. Second Offense: Minimum of 10 days in jail plus probation. Third Offense: 30 days minimum jail time. Fourth Offense: Minimum of 60 days in jail before you can be put on probation.

“Unfortunately we get people that get more than four DWI’s. If you get a fifth DWI conviction or an alcohol related offense, there is a minimum of two years in prison before you can be released,” said Wilson.

What are some other penalties you face if you are convicted of a DWI in the state of Missouri?

“The statute requires that if you get convicted of another DWI after your first one, you must have an ignition interlock device installed in your vehicle for a certain amount of time,” said Wilson. “In some cases that ignition interlock device may be installed during your limited driving privileges, and some courts will order that as a term of probation.”
