ALBIA, IOWA -- An Albia man convicted of killing his brother is scheduled to be sentenced in November.

Last week, a Monroe County jury convicted Richard Davis, 75, of the February 2011 killing of his brother doctor Gary Davis. Gary Davis was shot to death this home on Linden Lane in Albia.

Prosecutors had asked for a first degree conviction and a mandatory life sentence, but the jury returned a verdict of second degree murder.

Davis is scheduled to be sentenced in Monroe County District Court on November 21 at 1:30 p.m.

The maximum penalty for second degree murder is 50 years, but unlike a first degree murder conviction, Judge James Blomgren will have some discretion in sentencing Davis.
