Iowa texting ban not exactly tough

OTTUMWA, IOWA -- Our Facebook fans wanted to know what Iowa law has to say about cell phone use by drivers.

Iowa Code is pretty straight forward.

Drivers 18-years or younger driving with a graduated license or an instructional permit are forbidden from using any electronic device while driving.

That includes cell phones, iPODS, or gaming devices.

Iowa law considers this a primary enforcement issues for teens, meaning police can pull teen drivers on suspicion of using these devices.

No other probable cause is required.

For teen drivers, the penalty is $50.

Fully licensed adult drivers are permitted to use cell phones and GPS devices while operating a motor vehicle.

Adult drivers cannot receive or send text messages or emails while driving.

For adult drivers, texting is a secondary enforcement issue. Texting alone is not enough for a police officer to pull over an adult driver. Law enforcement must observe some other violation.

The fine for adults is $30.
