DES MOINES, IOWA (AP) -- Three Iowa Supreme Court justices removed from the bench in last month's election will leave as scheduled on Dec. 31, despite a lawsuit seeking to keep them in office.
The Des Moines Register says three lawyers who contended the Nov. 2 retention vote was illegal said during a court hearing on Monday that they are dropping a push to temporarily prevent the justices from leaving. However, they say they will to continue to press their claim that the Iowa Constitution requires that retention votes be on a separate ballot.
The lawyers halted their effort after learning the justices would fight the claim, which was filed in Polk County District Court.
The Gazette of Cedar Rapids says a judge will hold a hearing next year on the question of a separate ballot.
