Suspect wants judge, not jury, to decide his case

SCHUYLER COUNTY, MO. -- A Heartland man facing sex-related felony charges has decided he would rather a judge hear his case than a jury.

Joshua Lyons, 19, of Kirksville is charged with two counts of incest and one count of endangering the welfare of a child.     

The charges stem from incidents that investigators say happened in Schuyler County.

Lyons' jury trial was scheduled to begin Monday, October 18 in Schuyler County Circuit Court.

The bench trial before Judge Gary Dial will now start November 8 in the same courtroom.

Lyons remains behind bars as he waits on his trial to get underway.
