Judge denies Oswald's withdrawal of guilty plea

KIRKSVILLE, MO. -- A former Kirksville attorney, who pleaded guilty to a felony sex crime involving an underage boy, will serve more time in prison.

Tom Oswald, 85, formerly of Kirksville, has completed 120 days in the Sexual Assessment Unit in Fulton, Missouri, after pleading guilty to one count of second-degree statutory sodomy.

At the end of the 120 days, Oswald made a motion to withdraw his guilty plea, which was denied.

Saline County Circuit Judge Dennis Rolf then ordered Oswald to serve the remainder of his seven-year sentence.

The judge ruled it would be an “abuse of discretion" to release Oswald on probation, without serving any of the seven-year sentence.

Oswald was charged in connection with an incident, involving inappropriate sexual contact with a Kirksville boy who was 15 years old at the time of the crime back in 2007.
