Supreme Court overturns drunk driving dismissal

DES MOINES, IOWA (AP) -- The Iowa Supreme Court has overturned the dismissal of a drunken driving charge against a Burlington man who asked to keep the case alive.
   
A Burlington police officer arrested Todd Taeger after tests showed Taeger had a blood alcohol level of 0.258 percent, more than three times the legal limit.
   
The supreme court ruled Friday that the district court erred when it dismissed the charge without first considering Taeger's motion to suppress evidence about the possible revocation of his driver's license. It ordered the case back to district court for a ruling on Taeger's motion.
   
The court also ruled the state did not give adequate reasons for its decision to dismiss the charge.
   
A telephone message left for Taeger's attorney wasn't immediately returned. The Iowa attorney general's office declined comment.
