Delay in Tom Oswald case

We have new information Wednesday on the Tom Oswald case.

KTVO has learned Oswald's defense attorney has filed for yet another delay in the case.

If you recall, the now 84-year-old former Kirksville attorney is charged with two counts of second-degree statutory sodomy relating to alleged incidents involving a boy who was 15 at the time.

The charges were filed in August of 2007.

In his filing, Oswald's attorney lists health reasons as the need for the delay, saying the defendant is suffering from COPD, a hand problem that requires surgery and other illnesses associated with old age.

Oswald's case is being heard in Saline County, on a change of venue.

His trial is still set for October 27th.
