Charges amended in shooting case

KIRKSVILLE, MO. -- Charges are amended against three Saint Louis men involved in a Kirksville shooting last summer.
    
24-year-old Byron Smith, 24-year-old Calvin Shipp, and 21-year-old Lamont Wilkes, all of Saint Louis are now charged with conspiracy to commit assault in the first degree.

On June 22, 2008 all three men were involved in a shooting at the south McDonald’s in Kirksville.

That shooting left Justin Johnson of Saint Louis and Forest Roberts of Kirksville injured. The three suspects were originally charged with Assault in the First Degree and Armed Criminal Action.

“We had no contact with the victim Justin Johnson.  He's presented us with some very big obstacles such as he's wanted in questioning for another murder down in Saint Louis, he's got active felony warrants out for him,” said Adair County Prosecutor Mark Williams.

Johnson stopped cooperating with the police after he was released from the hospital following the incident.

Smith, Shipp, and Wilkes all pleaded guilty to the charges and are being held in the Adair County Jail awaiting transport to the department of corrections.
