KEOSAUQUA, IOWA -- Widespread attention has been drawn to Magistrate Judge Benny Waggoner's decision to approve a temporary jail release to Randy Barker, who was sentenced to 10 days for "Interference with Official Acts," and "Violation of a Protective Order."     

Barker left the Van Buren County Jail at 1:00 P.M. on Wednesday to attend a Red Sox baseball game in Kansas City with his father and brother. He returned to the jail in Keosauqua at 3:00 A.M. on Thursday.

Residents of Van Buren County, Iowa commented on the issue at Circle B in Keosauqua. 
    
"You commit a crime, you should serve your full time and not be released in any way or have any privileges," said Anna.

"A lot of people wouldn't be released. I guess it just depends who you are," said Sherry.

"It shouldn't be split up in half," said Eddie. "I mean how many other people would like to have that luxury?" 

"Well I would want to know more about the judge's reasoning," said Harold.

"If a person has committed a crime and judgment has been placed, then the length of that sentence has to be carried out," said Jeff.

On Thursday, KTVO received an e-mail from Barker's brother, Robert.

Robert Barker stated that he does not approve of Randy's behavior, "He has been quite a nuisance to some very decent people in our community," Robert wrote. "But the judge decided in the best interest of Randy's mental health to let him attend the game in Kansas City."   

Robert also stated in the e-mail that his brother Randy has been a Red Sox fan for 40 years and had never attended a game. He added that he is sure it will always be a bright spot in Randy Barker's life.

I'm fairly certain that under the terms of your work release you were released at a specific time in the morning and were to report back to the jail by a certain time in the evening, or some other such arrangement. In many cases, people serving some sort of shock detention are allowed WORK release so they won't lose their jobs. This cat in Iowa was only having to serve TEN DAYS. Couldn't he have served that and gone to a ball game some other times--there WILL be other ball games! If it were a one-time event like a wedding or a funeral, I would certainly understand--but not this.

Unlike people on here hideing behind a fake or no name i think that was pretty cool of the judge. I mean the guy was only doing 10 days for interferience. Big deal, he got a furlough to attend a ball game with his dad & brother. Maybe his dad or brother was on thier last leg or something.(Who knows)I'm sure the guy knew that if he did'nt return that he'd face a mandatory 5 years in prison. I did 60 days in jail not too long ago & i got out everyday to go to work & returned everyday after work. Although i was a prisoner i was treated as a human & not a caged animal. Just because we sometimes break the law it does'nt mean we're bad people. If this man was a danger to our so called society,i'm sure he would have stayed in jail. I'm sure all the do gooders on here would think that if a man has to set in jail for a fine that he or she could'nt pay that they also should be treated as hardened criminals. Just my opinion but i think people would be better off if they would mind their own business & don't worry about everyone else.

if you let him out for a baseball game maybe you let someone else out to goto a football game or even a pinic hello waht if he would ahve got lose and done something dumb there is no way you would ever found onece on the lose it is a wild gosse chase

for the most i agree you shouldn't be let go to attend anything if your in jail. but on the otherside of things if your not violent or a risk of escaping i could see a few things like family funeral or something. i know in Adair county in years past if you wasn't a risk and had been a model prisoner they would let you out for 1 day for Christmas. and you could also attend GED classes without a guard. and in those cases i don't believe there was ever an incident. i know they forgot to pick up a prisoner from GED and he waited for them. they didn't realize they had forgotten him until they was giving out supper. also if you will check. most all county jails have inmates that are released everyday to go to work. so those inmates are only in jail to sleep basically.

Here's an great idea. Why not let All the people in jail out and go home for Christmas, Thanksgiving and their kids Birthdays....??
mean come on....a baseball game? get real or get off the bench.

Heaven forbid he'd have to do ten days without interruption. Jail time is such an "inconvenience" when there are important life-changing things such as ball games going on. That's nuts; what WAS that Judge thinking, indeed?
