KIRKSVILLE, MO. -- The first steps have been taken in the retrial of former Kirksville dentist Steve Barber.
Barber was convicted on two counts of tampering with a witness and was sentenced to five years in prison. He was found guilty of offering a bribe to the parents of a sexual assault victim. In exchange for the money, they would agree to not cooperate with the prosecution in the case. The case involved Barber's friend, longtime Kirksville attorney Tom Oswald. Oswald later pleaded guilty and died in prison.
Barber appealed his conviction to the Western District Court of Appeals, who ruled that since a portion of the testimony was not available, due to a recording issue, that they were unable to rule on the appeal and sent it back to Adair County for a new trial.
A review of the case is scheduled for next Tuesday when Judge Karl DeMarce, who was assigned to the case, is expected to schedule a date for a new trial.
Barber has remained free since his conviction.
