'Too fat to fly' woman loses in court

NEW ORLEANS -- Southwest Airlines wins a round in court. A federal judge has dismissed a lawsuit filed against the carrier by a New Orleans woman who claims a gate agent told her she was "too fat to fly." The woman says she was told she couldn't get on a flight unless she bought two tickets.

The judge dismissed the case because the woman missed the deadline for responding to Southwest's request for the case to be tossed. The judge says Southwest's request seems to have merit, but dismissed the suit without prejudice, which means the woman can ask for the case to be reopened.
